- 杨佳案甫一初审，即引来不少人针对办案程序的质疑。争议之处包括：首先，大家认为由上海当地警察进行侦查未能避嫌，建议异地审理；其次，还有专家分析判断杨佳系精神病人，而上海法庭对此未作理会。
- 在证据不足的情况下，是让犯人跑掉，还是让法律跑掉？这的确体现了不同国家的不同选择。作为这种选择的极端形式，是上世纪二十年代国民党“清共”时期喊出的著名口号：“宁肯错杀三千，不可放过一个”！
